These terms are the agreement between you and FugueWorks, LLC ("we", "us") for your use of the ReChannel app. By using ReChannel you accept them. If you do not, please don't use the app.
ReChannel offers you something to do with a distracted moment — usually a small, specific gesture toward a person you care about — at times it selects based on the preferences you set and what it observes about when you respond. Suggestions are generated partly by automated systems, including AI, using the information you have given the app. ReChannel does not observe your activity in other apps.
You must be at least 16 years old, and old enough to enter a contract where you live. If you are under the age of majority in your jurisdiction, a parent or guardian must agree to these terms on your behalf.
ReChannel requires a paid subscription after any free trial. Subscriptions are sold as an auto-renewing purchase through Apple's App Store.
Deleting your account does not cancel your subscription. Because Apple — not us — holds the subscription, deleting your ReChannel account leaves billing running. Cancel first, then delete.
Suggestions are generated automatically and will sometimes be imperfect, mistimed, or simply wrong for your situation. You are always free to ignore one. You are responsible for what you actually say and do — a suggestion is a prompt, not an instruction, and sending a message is your decision.
We have built guardrails intended to keep suggestions from using guilt or shame, from putting words in your mouth about how you feel, and from referring to people or facts you never entered. These reduce the risk; they do not eliminate it. If something lands badly, we would genuinely like to know.
What you put into ReChannel — the people you add, your notes, your aspirations — stays yours. Our handling of it is described in our Privacy Policy, which forms part of these terms.
You are responsible for having a reasonable basis to record information about other people in a private, personal tool. Do not use ReChannel to store information about someone in order to harass, monitor, or pressure them.

We may suspend or end your access if you do these things.
We aim to keep ReChannel working, but we do not promise uninterrupted service. Features may change or be removed. The app is designed to keep working when our server is unavailable — it falls back to suggestions bundled inside the app — but some functionality needs a connection.
You can stop using ReChannel at any time, delete your account from within the app, and cancel your subscription through Apple. We may end or limit your access if you materially breach these terms, or if we discontinue the app. If we discontinue it, we will give reasonable notice where we can.
To the fullest extent the law allows, ReChannel is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will meet your requirements, that suggestions will be suitable, or that the app will be error-free.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or damage to relationships, arising out of your use of ReChannel. Our total liability for any claim relating to ReChannel is limited to the greater of the amount you paid us in the twelve months before the claim, or $100 USD.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
These terms are between you and us, not Apple. Apple is not responsible for ReChannel or its content and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them. To the extent any warranty is not effectively disclaimed, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation.
We may update these terms. We will change the date at the top, and for significant changes we will tell you in the app. Continuing to use ReChannel after a change means you accept the updated terms.
These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. Disputes will be brought in the courts of Virginia, except that either party may seek relief in Virginia small claims court where eligible.
